A LOCAL construction company, Best Solutions Enterprises (Pvt) Ltd, has sued Chitungwiza Central Hospital for breach of contract after the latter failed to pay $8 814 for the renovation of its toilets.

Both parties appeared before Chitungwiza magistrate Marehwanazvo Gofa for a pre-trial conference on Friday.

Best Solutions was represented by Harare lawyer Takesure Thondlanga of Thondlanga and Associates. Part of the copmpany’s court application reads: “Sometime in September 2011 plaintiff (Best Solutions Enterprise)and defendant (Chitungwiza Central Hospital) entered into a contract of which plaintiff would renovate defendant’s toilets. Plaintiff charged $14 932 and the defendant paid in full.

“After plaintiff had completed the job defendant asked plaintiff to change the type of the floor tiles and toilet cisterns and defendant was served with a quotation for the additional material.

“Defendant is in breach of contract because it has refused to pay for the additional materials that were delivered to its place.”

Best Solutions is claiming $8 814 for damages for breach of contract plus interest from December 10 2011 to date. Trial date is yet to be set.
