HIGH Court judge Justice Joseph Mafusire has issued an order interdicting the University of Zimbabwe (UZ) from interfering with Romeo Tafadzwa Musemburi’s studies on account of his pending criminal matter over the Baba Jukwa saga.

Justice Mafusire on Monday ordered the UZ to issue Musemburi with a new student identification card and release his results.

Musemburi, a third-year economics student, is facing charges of attempting to subvert a constitutional government, following his arrest on June 30 for allegedly authoring a subversive statement and posting it to the phantom Facebook character Baba Jukwa’s gmail account.

He claims that he lost his UZ identification card during his arrest and accused university authorities of refusing to give him a replacement document. In his urgent High Court chamber application, Musemburi also accused the university of denying him access to his results.

The order by Justice Mafusire was issued by consent of both parties’ lawyers.

Part of the order reads: “The first respondent (UZ) is ordered and directed to cause the issuance of a replacement University of Zimbabwe Winter School student identity card/document to applicant (Musemburi) on the day this order is served on the third respondent (UZ Registrar).

“If for whatever reason the applicant is not given the new student identity card as specified above, first respondent shall cause or permit, allow and/or authorise that applicant have unrestricted access to his results, the university library and all other places for which a student ID is required including sitting for his examination for winter school on 5 & 7 August 2014.”

“The first respondent is hereby interdicted from interfering with applicant’s on campus residence and studies including but not limited to immediate access to his 2nd year, Final semester results on account of his pending criminal matter in CRB6915/14.” Musemburi was represented by human rights lawyer Tonderai Bhatasara.

The UZ student is yet to undergo trial over his alleged involvement in the Baba Jukwa saga and is out of custody on $100 bail.
