THE legal wrangle over ownership of Trauma Centre medical facility in Harare ended yesterday when the Supreme Court ruled that African Medical Investments director Peter Annesley was the rightful owner of the property.

The ruling effectively means Vivek Solanki can no longer claim ownership of the property.

Annesley and Solanki had been fighting for control of the facility which they previously co-owned before their fallout in September 2011.

But by late last night, Annesley and his lawyers Beatrice Mtetwa and Harrison Nkomo were battling to evict Solanki with the assistance of the Messenger of Court.

However, the Messenger of Court later left the facility at around 6:30pm to seek police assistance after he was allegedly harassed by Solanki’s subordinates who were resisting eviction.

A journalist with Press TV was also not spared the harassment.

Through his lawyer Jonathan Samukange, Solanki said he was entitled to 48 hours’ notice to vacate the premises where he has been operating from for over 16 years.

Samukange arrived at the private hospital in the company of Brigadier Walter Usher Tapfumanei, a director in the Central Intelligence Organisation.

Sources told NewsDay that Solanki had spent the better part of yesterday removing hospital equipment from the facility soon after the judgment was handed.

Part of the judgment read: “It is ordered that the applicant be and is hereby restored to possession and occupation of premises known as Stand 2924 Salisbury Township of Salisbury Township Lands situated at Number 15 Lanark Road, Belgravia, Harare.”

The court ordered Solanki to meet all the legal costs.
