THE long-running legal wrangle between Gokwe Town Council and its fired secretary Tapiwa Marongwe took another twist last week after the Labour Court ordered his reinstatement without loss of benefits or be given an exit package amounting to about $77 000.

According to the determination, the local authority should comply with the order within 14 days.

Marongwe joined the local authority in September 2009 as town secretary but was suspended in 2012 for alleged tender manipulation, fraud and incompetence. He challenged the decision in court demanding more than $129 000 in outstanding salary and terminal benefits.

Arbitrator Elisha Ganyani last week awarded him $76 793,99 and alternatively ordered that Marongwe be reinstated to his previous job without loss of benefits. Part of the ruling read: “Having considered the facts, submissions made by the parties together with the provisions of the labour laws. I make the following orders: the claimant must be reinstated to his original position without loss of pay and benefits.

“If reinstatement is no longer an option, the claimant be paid outstanding salaries, cash in lieu of leave, notice, pay and damages as tabulated.” Ganyani concluded that Marongwe’s suspension and expulsion was done unprocedurally.
