Prosecutor Memory Mandudzo had recommended a jail term of between 10 and 15 years for Zvikomborero Chimudondo after he was convicted of aggravated sexual assault.
But the magistrate said the proposed sentence was too harsh considering that Mandudzo was a first offender and still young.
Chimudondo will serve an effective two years after one year of the sentence was suspended.
The court heard that on the April 28 this year, Chimudondo who was a herdboy at the juvenile’s residence, went to sleep together with the victim and his other brother.
When the juvenile had fallen asleep, Chimudondo started caressing the juvenile who then woke up and asked him what he was doing. He told the juvenile to touch the ground before wearing a condom and then sodomising him.
The matter came to light the following day after Chimudondo left the used condom behind the door.
