Pastor Prince Tsoka (27), who resides in St Mary’s, Chitungwiza, was found guilty of assault when he appeared before Chitungwiza magistrate Lazarus Murendo.

Circumstances were that on the April 17 at around 2000 hours, Tsoka went to Calvin Chabveka’s house in Unit N. He had gone to collect his car which he had given to Chabveka’s mother as collateral for money he had borrowed.

The court heard that the accused requested to go for a test drive before he could pay back the money and was accompanied by the complainant. When they reached Makoni shopping centre, Tsoka took out a $20 note and told the complainant that it was the money he was going to pay as fine after beating him up.

The accused then assaulted the complainant with a fist and struck him on the head with an iron bar on the head. The iron bar was never recovered. In his defence, Tsoka said he only assaulted him with an open hand after he had damaged his car.

“I did not allow them to use my vehicle, but I was tipped off that they were using it to sell dagga (mbanje) at Chikwanha. They damaged it, that is why I hit him, but I only used an open hand,” he told the court. Tendai Mukariri appeared for the State.
