THE Mining Industry and Pension Fund has made a High Court application seeking to evict its tenant Nuffield Funeral Home over unpaid rentals amounting to $53 237.

The funeral company is alleged to have failed to pay its rentals for the use of MIPF’s Tafara Building located at 58 George Silundika Avenue in Harare over the past 10 months. Through its lawyers Kadzere, Hungwe and Mandevere legal practitioners, MIPF is seeking cancellation of the lease agreement and eviction of the funeral company.
According to a lease agreement signed by the two parties last May, the funeral company had agreed to pay $3 800 in monthly rentals and an additional $700 as operational costs on the first day of each month.
However, since the signing of the alleged lease agreement, the funeral parlour is said to have failed to pay its dues, prompting the property owners to seek recourse at the High Court.
Part of the court papers read: “In the period between May 2013 to February 2014 defendant breached the terms and conditions of the lease agreement by failing to pay rent and operating costs in full, thereby accruing arrears broken down as follows: (a) $30 833,64 in respect of rent (b) $22 403,99 in respect of operating costs.”
By yesterday, Nuffield Funeral Home had not yet entered an appearance to defend the eviction notice.
