BANKET — New Year’s celebrations turned nasty for a Nyabira family after a neighbour, incensed by loud music, descended on the merry-makers injuring one of them.

This was disclosed during the court appearance of Thomas Chiwanza (26) of Green Way Farm, Nyabira, at the Banket Circuit Court facing assault charges as defined in Section 89 of the Criminal Law (Codification and Reform) Act chapter 9: 23 yesterday.

He pleaded guilty.

Prosecutor Arthur Bosha told the court that on January 1, 2014 at around 3am, the complainant Zebron Kaseke (45), a welder, was celebrating the New Year with his children playing loud music on their radio.

The accused, a neighbour, who was in a drunken stupor confronted the complainant and demanded that he stops playing music at high volume.

Complainant refused to budge and this incensed the accused who started hurling insults at Kaseke.

As if that was not enough, the court heard, accused armed himself with a rock boulder and attacked Kaseke, who sustained a deep gush on the forehead. Magistrate Ngoni Nduna sentenced Chiwanza to an effective nine months’ imprisonment.
