MORE than 48 Epworth families have been given until tomorrow to vacate their premises after the land owner Sunway City obtained a High Court eviction order against them.

Last Thursday, Sunway City, a subsidiary of the Industrial Development Corporation of Zimbabwe (IDCZ), engaged the services of the Deputy Sheriff and served the affected families with the eviction notice. Part of the notice reads: “Defendants and all persons claiming occupation through them are hereby instructed to vacate the premises within 48 hours of issue of this notice. Ejectment date 26/11/2013.”

The move by Sunway City to seek ejection of the families followed the granting of the writ of ejectment on October 23 this year after the firm won the eviction matter last year before High Court judge Justice Lavender Makoni.

The affected families are members of Chinamano Housing Co-operative.

“Whereas Sunway City (Pvt) Ltd obtained an order in the High Court of Zimbabwe on the 26th of September 2012, against Luckmore Andresome, Carlos Mushawathu, Tonderai Mavhudzi, Alois Chihobvu and 44 others cited as respondents above, ordering them and all persons claiming title through them to be ejected and demolish any structures constructed on the remaining extent from out of Venterburg Estate Harare, at present occupied by respondents as appears off record,” the eviction order added.

“Now, therefore, you are and directed to eject the said (respondents) and all persons claiming title through them, their goods and possession from and out of all occupation and possession whatsoever of the said property and to leave the same, to end that the said Sunway City may peaceably enter into and possess the same, for in so doing this shall be your warrant.”
