Eight years of the sentence were, however, suspended on condition that he restitutes the complainants a combined total of $12 405 by December 31, 2013.

The court heard during trial that on June 23, 2011, the accused approached Mubaiwa at around 7 o’clock in the evening while he was offloading some firewood from his vehicle. He threatened him with an axe, demanding money and some valuables. He then stole $2 000 and other valuables from the complainant.

On August 4, 2011, again at around 7 o’clock in the evening, Musemwa, with two accomplices armed with an axe, matchet and knobkerrie, broke into Asa’s cottage in Greystone Park.

They threatened to kill Asa and his wife before stealing their mobile phones.

They locked them up and headed for the main house where they also threatened the house owner before stealing $150 from him.

On August 29, 2011, the accused broke into Martin’s house and threatened her family to comply with his orders before stealing laptops, several mobile phones, two international passports and $2 935 in cash.

On October 8, 2011 at around 7 o’clock in the evening, the accused, together with his two accomplices, broke into Nyamakura’s house and confronted his six children in the lounge after grabbing the maid. The accused proceeded to the bedroom from which they dragged the complainant and his wife to the lounge where they threatened to kill everyone before stealing two laptops, several mobile phones and other valuables as well as $2 210 cash.

They locked the complainant and his family in the toilet before going away.

The accused also robbed Clark on October 26, 2011 after which he was arrested following police investigations.

All the complainants positively identified him on October 28, 2011.
