ASPIRING MDC-T Makoni west MP Patrick Sagandiya who appeared in court on Tuesday facing public violence charges is likely to miss the nomination court sitting set for today after the State invoked section 121 barring his release.

REPORT BY STAFF REPORTER

Sagandiya, along with two others, are facing allegations of assaulting members from journalist Grace Kwinjeh’s camp during primary elections.

He was granted $100 bail by Rusape magistrate Shingi Mutiro, but the State led by prosecutor Tirivanhu Mutyasira invoked section 121 of the Criminal Procedure and Evidence Act to stop his release.

He was remanded in custody to July 2. Charges against Sagandiya (38), Lovemore Chifomboti (36) and Moses Ndora (33) are that on June 22 this year at Nyabadza Bussiness Centre where the party was holding primary elections, they assaulted members from Kwinjeh’s camp.

The complainants are Tazviona Marima, Canaan Nyamombe and Norman Yasini. It is alleged on the day in question a scuffle ensued over the eligibility of party members who were supposed to vote.

When some voters were turned away, the complainants closed the ballot boxes to indicate that the voting exercise was over.

According to the State, this did not go down well with the accused who then allegedly assaulted the complainants with open hands, booted feet and stones.

It is further alleged that after the fight, the accused went away and the complainants made a police report.

In opposing bail, Mutyasira said there was likelihood that the accused were going to commit a similar offence.

Following the disputed elections in Makoni West, Kwinjeh has said she would not accept the results where she was previously declared the winner before a decisive re-run she lost to Sagandiya.
