ZEC evicts city businessman

THE Zimbabwe Electoral Commission (ZEC) has evicted a Bulawayo businessman from its house in Famona suburb after he failed to pay rentals which had amounted to over $1 900.

ZEC had to approach the Bulawayo High Court seeking the cancellation of the lease agreement and an order for the businessman Blessing Zibowa, director of Crowrick (Pvt) Ltd, to pay $1 942,79.

Bulawayo High Court judge Justice Maphios Cheda gave a default judgment after Zibowa did not oppose the ZEC application.

“It is ordered that the lease agreement entered into on the 31st of October 2011 between the parties be and is hereby cancelled,” reads part of the ruling.

“The first defendant (Crowrick) and all those who claim title through it should be and are hereby evicted from No 23 Rylander Court, Windsor park, 16th Avenue, Famona, Bulawayo. Payment of the sum of $1 755,79 being arrear rentals and operations expenses by defendants jointly and severally, one paying the other to be absolved.

“Payment of the sum of $200 as holdover damages from the 31st of October 2012.”

ZEC and Zibowa signed a lease agreement in which the company was to occupy the electoral body’s house in Famona paying $200 per month in rentals.

Operation expenses were agreed to be at 4% on the total expense of the building.

Zibowa had bound himself as the surety and co-principal debtor of the company in the event that it breached the agreement.

However, the company failed to pay rentals and the money amounted to $ 1 942,79, prompting ZEC to approach the court.
