Rastafarians to keep pressuring govt to legalise mbanje

THE Rastafarian community in Harare yesterday said they will continue mounting legal battles to force government to legalise mbanje (marijuana) smoking.

Speaking during a memorial service of their departed member and self-proclaimed mbanje smoker Amos Mupfudza, who died in August while his Supreme Court challenge was still pending, a spokesperson for the community, who identified himself as Ancient Binghiman, yesterday vowed to pursue Mupfudza’s court case to finality.
Binghiman said their group, known as Dzimbadzemabwe   Nayabinghi House of Rastafari, would this week meet lawyers to pursue the court case.

“Police brutalised him (Mupfudza) for possessing marijuana, we told him to continue the good fight. I wonder why police would brutalise a Rastafarian because a Rasta is a peaceful man.”

Mupfudza was arrested in January this year and allegedly tortured for possession of the drug and alleged in his challenge that the move infringed his constitutional rights. He was charged with three counts of contravening Section 157(i) (a) of the Criminal Law (Codification and Reform) Act Chapter 9:23.

Mupfudza had challenged the classification of mbanje as a dangerous drug and criminalisation of its possession, arguing his Rastafarian religion allowed him to partake of the drug.

In his submission pending at the Supreme Court, Mupfudza said: “Rastafarianism is a recognised religion. The Rastafarians consider dagga a holy herb which they use in a variety of forms in order to communicate with their Creator.

“The Rastafarians have a genuine constitutional entitlement to have their religious practices protected in the same manner as Christians, Jews or Muslims.”

      Why shouldn’t marijuana be legalized? It is natural unlike beer and tobacco . Like anything on earth mbanje is subject to abuse just like beer or even sadza chairo.

          Mbanje cannot be legalised, asi when you suggest that the constitution criminalises a religion then you are using the law to do exactly the opposite of what it is supposed to do, that is, to uphold the rights of all including the right to religion.

Our society and health system are still evolving unlike in those countries where there are nets to take care of those who find themselves compromised due to use of this drug. Lets get our health, economic and social life in line before we get carried away with this!

      If facts are anything to go by, how many people die from alcohol and/or tobacco related ailments? and how many die from ‘ganja related illnesses’…? Did you know that marijuana is also a medicine? Kana waita liveer cirrhosis from boozing, remember to light up a spliff to ease the pain…

    Legalise it. But it should be controlled. It should be sold in licensed shops so that tax goes to government. People must not carry more than 100 grams of it without licenses. There should be a ganja levy just like beer levy and tobacco levy. There should also be incentives and subsidies for ganja farmers as it will bring a lot of foreign currency.

Rastafarians are now synonymous with lawbreakers. For as long as the matter is stil pending before the courts ganja smoking is a transgression of the statutes and perpetrators wil be brought to book.     Banning/criminalising mbanje is futile exercise and complete waste of time and resources. If you lock up every single person who smokes, the prison system will collapse.
    Rather than legalising it, which would never wash in a society like Zimbabwe with holier than thou attitudes, just decriminilise it and allow people to smoke in the privacy of their own homes and carry small amounts on their person.

    There are no apparent health hazards from weed, unlike beer and cigarettes. In my opinion people should be allowed to smoke just as our forefathers did.

    God created everything in his wisdom including cynide, snakes , sulphuric acid, mbanje, chibage , nzungu and everything else so for someone to say that it must be taken because God created it then thats being foolish . Mbanje may look harmless but my own experience tells me it can do permanent damage to the brain . A friend of mine while we were still in form 2 in 1987 took it and his life changed for good . Today he is demented and that was the end of his rather promising future because he was good in school.
