A 19-year-old Waterfalls teenager will rue the day he laid his hands on his 12-year-old girlfriend after he was slapped with a 10-year jail term for bedding the minor.

Report by Charles Laiton The teenager, Wilson Sami admitted to having sexual intercourse with the girl and told the court that the act was consensual.

  But prosecutor Alan Goche argued that the girl, according to law, was incapable of consenting to sexual intercourse, thus when Sami had sexual intercourse with her it was rape.

  Regional magistrate Fadzai Mthombeni eventually slapped Sami with a seven-year effective jail term after suspending three years on condition of good behaviour.

  According to Goche, Sami and the girl had an affair and on August 26 this year, the girl visited Sami at his residence in South Lea Park, Waterfalls.

  The court heard that as the pair was in Sami’s room, he locked the door, grabbed the girl’s hand and fondled her body after which he forcibly removed her pants and had sexual intercourse with her once.

  Although Sami threatened the girl not to report the incident, she spilled the beans upon getting home late leading to Sami’s arrest.

  Meanwhile, a 26-year-old Kuwadzana man Auther Kofi escaped an effective prison term by a whisker when he was slapped with an $800 fine after being convicted of bedding a 13-year-old girl.

  Initially Kofi was charged with rape, but the evidence adduced in court suggested it was consensual sexual intercourse.

  Prosecutor Goche told magistrate Mthombeni that Kofi had an affair with the girl and sometime in December last year, he approached her at her parent’s residence ostensibly to collect his magazine.

  The court heard he laid the minor on a sofa and had sexual intercourse with her once without protection.

  However, the matter came to light in March this year when the girl’s mother intercepted letters from Kofi to her daughter.

  She then quizzed her daughter over the letters and she spilled the beans leading to Kofi’s arrest.
