Home Affairs co-minister Kembo Mohadi was left with egg on his face last Wednesday after a Bulawayo High Court judge ordered the liquidation of a company that the Zanu PF minister had attempted to grab from a Beitbridge businessman, Reginald MacGillway Dawson.

Dawson approached the High Court last month seeking the liquidation of Nerry Investments Private Limited after Mohadi attempted to elbow him out and grab the firm.

According to court records, Mohadi had 10% shares while the late Tenjiwe Lesabe had 10%, John Josias Moyo (20%), R Dawson (20%), SJ Dawson (20%) and Red Queen Trading (Pvt) Ltd (20%).

The shares were given to Mohadi, Lesabe and Moyo for free by a man only identified as Ezra Ndlovu (now deceased) when he allegedly tried to steal Dawson’s company.

According to court papers, the shareholding was changed after Mohadi allegedly stormed Dawson’s house with armed guards demanding a change of the company share structure.

Said Dawson: “The onset of the fallout really started when Mohadi arrived at my house on 13 November (last year) at 1pm being driven in his official ministerial motor vehicle and accompanied by two bodyguards armed with AK-47 assault rifles.”

Bulawayo judge Justice Martin Makonese on Wednesday ordered the liquidation of the company and appointed a liquidator, Barbra Lunga of Impact Trust and Executors (Pvt) (Ltd), to oversee the liquidation.

“Pending the determination of this matter, it is hereby ordered: Nerry Investments (Pvt) (Ltd) (hereinafter called ‘the company’) be and is hereby placed under provisional liquidation pending the granting of the final order of liquidation or the discharge of this order as the case might be. Barbra Luna of Impact Trust and Executors (Pvt) (Ltd) be and is hereby appointed the provisional liquidator of the company with the powers set out in section 221 (1) and (2) of the Companies Act (Chapter 24.03). The existing Directors of the company be and are hereby divested of their powers and authority in such capacities,” ordered Justice Makonese.

In a related matter, Mohadi and Moyo are being accused of grabbing Dawson’s six trucks and six tankers, prompting his lawyer Ndabezihle Mazibuko to write a letter of complaint to Sasfuel and Chem (Pvt) (Ltd)’s lawyer, Munyaradzi Nzarayapenga, which released the vehicles to the pair after liquidation.

“We wish to advise that our client has not received the trucks. There appears to have been some collusion in Beitbridge where Mr John Moyo currently in litigation with our client together with Minister Kembo Mohadi apparently obtained the release of the trucks to him on the pretext that he was acting on behalf of Red Queen Trading (Pvt) Ltd. Please note that Mr John Moyo does not represent Red Queen Trading and is not a shareholder or a director of Red Queen and has absolutely no authority to take custody of the trucks,” wrote Mazibuko.

However, Moyo allegedly refused to release the trucks last week after Dawson went to recover them in the company of the police.

Moyo and his son, Brian Moyo, have another pending criminal case at Beitbridge Magistrates’ Court where Dawson is accusing them of fraud after they grabbed his other company, Digilan Investments.

The matter is continuing tomorrow and Mohadi is expected to testify.
