Copac co-chairperson and Nyanga North MP Douglas Mwonzora has made an application for referral of his six-year-old case to the Supreme Court accusing the Attorney-General’s Office of selective prosecution and discrimination.

The application by Mwonzora, who is also the MDC-T spokesperson, was brought about after he was summoned to court over a case he allegedly committed in 2006.

Mwonzora is alleged to have swindled Everson Shepard Dandazi of over Z$5 billion in a property deal in August 2006.

Regional magistrate Fadzai Mthombeni postponed the matter to June 20 for determination.

The MP, who is charged with theft of trust property, was represented by Advocate Thabani Mpofu. In his application, Mpofu said: “The case dates back to 2006 and is coming out for trial in 2012. There are certain constitutional issues that arise and we intend to move for relief in terms of Section 24 (2) of the Constitution of Zimbabwe.

“We ask the court to refer the matter to the Supreme Court for constitutional consideration.”

However, prosecutor Sidwell Chinzete opposed the application arguing Mwonzora had not made any case that warranted the Supreme Court’s intervention but should defend himself during trial.

“The application should be dismissed and allow the matter to proceed to trial soonest merely for its unreasonableness,” Chinzete said.
