The medical affidavit produced by the State in the trial of the Reserve Bank security officers specifying the degrees of injuries sustained by former advisor of the bank Munyaradzi Kereke’s personal chauffeur after an alleged brutal attack, was allegedly fraudulently acquired, raising the State’s concerns over who was the brains behind its compilation.

The medical affidavit was allegedly compiled by one Jacob Chiweshe, a State registered nurse based at Parirenyatwa Hospital who is also a brother-in-law to Dr Johannes Marisa who was purported to have compiled the affidavit. Chiweshe has since been arrested and is assisting police with investigations and the police officer who arrested the RBZ security officers, only identified as Constable Mavhene, was yesterday issued with a warrant of arrest after failing to attend court.

The two accused, George Nyahuye and Phillip Dendere, are on trial facing an assault charge where it is alleged they severely attacked the complainant, Kereke’s personal driver,Privilege Maturure, on March 12 this year after stalking Kereke for nearly 30 minutes.

But in their defence represented by Advocate Linos Mazonde, the two accused stated that when Mavhene arrested them, he remarked that they had “crossed the paths of important people”.

They also said at the same time Kereke “threatened to prepare a very good medical affidavit” against them. The court heard that Maturure was allegedly severely assaulted, at Rock Foundation Medical Centre, and referred to Parirenyatwa Hospital where a medical affidavit was purportedly compiled by Dr Marisa, who testified and dismissed the claims. Prosecutor Liberty Gono told provincial magistrate Kudakwashe Jarabini that the report purportedly authored and signed by Dr Marisa, was a dubious document.

“Last time we were given time to subpoena the medical doctor who compiled the affidavit under dispute, but unfortunately the doctor who is reflected as the author of the affidavit is in attendance and has confirmed to our office that he is not the one who compiled it,” Gono said.

“The State has now managed to identify the actual person who compiled the medical report, he is Jacob Chiweshe and is assisting police with investigations.”

When Dr Marisa took to the witness stand he was very emotional and he said: “I am actually alarmed by the degree of forgery which is on this paper I am holding signed on March 12 this year purporting to contain my signature which is way far from mine.

“I left Parirenyatwa Hospital four years ago and I do not go there anymore since I am operating a private surgery and I am always busy. I would want the court to fully investigate who ever brought this paper to establish how it was obtained. It has defamed me as I am someone with a good reputation,” Marisa said.
