MATOBO — Chief Malaki Masuku on Sunday referred an estranged couple fighting over maintenance of their 15-year-old daughter to the civil court after the traditional court failed to resolve the dispute.

“I will write you a letter referring you to the civil court for a decision on how the child’s support should be handled,” Chief Masuku ruled.

Sometime early last year Phathani Sibanda walked out on his wife Musa Maphosa to live with another woman at a nearby farm.

Maphosa later reported the matter to Chief Masuku demanding her husband to provide for his daughter’s upkeep.

But the matter hit a brick wall after Maphosa’s mother refused to accept anything from Sibanda for dumping his wife.

Sibanda told the chief’s court that he wanted to support his child but was puzzled after his in-laws indicated they would not accept anything from him while his estranged wife still insisted on payment of maintenance.

Sibanda said he preferred sending material things and paying the daughter’s school and medical expenses.

“I surrender the homestead, livestock and everything at our matrimonial home to Maphosa,” said Sibanda.

“That home is now for the Maphosa family. I will never set my foot at that home. What I need is the clearance to be able to support my child.”
