Destiny of Africa Network (Danet) founder and president Reverend Obediah Musindo is being sued at the High Court together with his firm and employee Kurai David Pick over an unpaid $6 000 debt.

A Harare company, Elishmax Enterprises, is cited as the plaintiff under case number HC1611/12.

The summons of the case were served on February 15 this year on Susan Sumburera, Musindo’s receptionist, who accepted service on behalf of her boss.

Pick and Danet were cited as second and third respondents, respectively.

Elishmax Enterprises’ lawyer Dumisani Kufaruwenga told NewsDay yesterday Musindo was yet to enter an appearance to defend.

Part of the summons read: “. . . payment in the sum of $6 000 being money lent to the three defendants, which amount when due and despite demand, the defendants refused, failed and or neglected to pay”.

According to the summons, on December 31 last year, Elishmax Enterprises entered into an agreement with Musindo and Pick who were acting on behalf of Danet for a loan.

The terms of the agreement were that Elishmax Enterprises would loan, pay and advance the sum of $4 000 to Musindo and his firm.

It was allegedly agreed Musindo would repay the money on or before January 6 this year, failure of which the capital sum would attract interest at the rate of 10% per day.

It was also reportedly agreed Musindo would surrender and deliver to Elishmax Enterprises a motor vehicle as security for the payment of the debt, which he did.

However, Musindo and his company allegedly failed to pay back the loan on the agreed dates and interest started accruing on the said capital until it reached $4 000.

It is alleged the total amount owing, including interest, rose to $8 000 of which Musindo and his company paid $2 000, leaving an unpaid balance of $6 000 which has resulted in the civil suit.
