KADOMA — An 86-year-old man from Rimuka suburb, Sanyani Chimutari, allegedly entered his tenant’s room at night, removed her pants and tights before having sex with the complainant while she was asleep.

The complainant only awoke to find the accused in the act, a magistrate heard last week.

Chimutari appeared before, Kadoma magistrate Takawira Mugabe facing rape charges as defined in Section 65 of the Criminal Law (Codification and Reform) Act Chapter 9:23.

The court heard that on October 2, the accused entered the 23-year-old woman’s room within his house.

The matter was reported to the police, leading to the accused’s arrest.

The State had opposed bail arguing Chimutari was facing a serious charge and was likely to abscond and that he lived at the same house with the complainant.

However, the magistrate remanded him to January on $20 bail.
