The Chitungwiza Deputy Sheriff has been arrested and charged with allegedly faking a copy for return of service used by the High Court to grant an order resulting in a businessman losing his residential stand.

The Messenger of Court, Victor Gwekwerere (42), appeared before Chitungwiza magistrate Lazini Ncube yesterday charged with abuse of duty and was remanded to today for trial on $20 bail.

The case was reported to the police by the director of Stenrob Foods, Stanford Machokoto, after his stand number 17335 Zengeza was executed by the Master of the High Court following a court order obtained under case number 4130/7.

According to prosecutor Henry Muringani, on September 4 this year, Gwekwerere allegedly served summons on Machokoto through one Chuma who was said to be staying with Machokoto at the same residence, Number 14961 Zengeza 3 Extension.

The State alleges Machokoto did not receive court summons from anyone and never stayed with anyone by the name Chuma at his residence. It is alleged the summons allegedly served on a purported Chuma had no full particulars or the signature of the recipient.

The State alleges Gwekwerere issued the purported return of service to the applicant, whose name was not mentioned in court papers, but who later used the same papers at the High Court where a court order to seize Machokoto’s stand was obtained.
