FILABUSI — A 43-year-old man from Imbizo Barracks Junction Farm in Filabusi assaulted the 64-year-old mother of the man who eloped with his daughter, with an iron rod recently, a magistrate heard on Wednesday.

Phenious Ndlovu pleaded not guilty to assault charges when he appeared before magistrate Shillah Nazombe.

However, the magistrate convicted and sentenced him to 30 days in jail with an option of a $50 fine. The State case was that on April 11 this year at 10:30am, Ndlovu went to the home of the complainant Selina Senda in Gwatemba to resolve a domestic issue concerning his daughter Thandekile Ndlovu.

The court heard that Thandekile eloped with Senda’s son whose name was not mentioned in court, with the intention of getting married later. Their discussion turned bitter as they failed to reach an agreement, prompting Ndlovu to pick an iron rod that he used to strike Senda with once on the left hand.

Ndlovu was restrained from further assaulting Senda by one, Mangena, who was accompanying him.

Senda later reported the matter to the police, leading to Ndlovu’s arrest.

Sentencing him, the magistrate said the fact Ndlovu attacked the defenceless elderly woman using such a weapon aggravated his offence hence, the sentence.
