South Africa-based Zimbabwean businessman Mutumwa Mawere has renewed his bid to recover his companies and assets running into several millions, which were reportedly seized by government during the period he was specified.

Mawere, whose specification was recently revoked, on Friday filed a High Court application asking government to hand back 26 of his firms, reportedly grabbed by government under the Presidential Powers (Temporary Measures) (Reconstruction of State-Indebted Insolvent Companies) regulations of 2004.

Mawere was specified in terms of Section 6(1) of the Prevention of Corruption Act (PCA) after he was accused of externalising huge amounts of money. Resultantly, all his companies were placed under government control.

During the period of his specification, Mawere was prohibited from running the companies or claiming shareholding thereof.

Mawere said: “I am advised and verily believe that the revocation of my specification means the control of all my assets should revert to me.

“I am further advised and verily believe that any disposal, contracts entered into, the increase of my indebtedness or acts adversely affecting my estate, the performance of any act as a director of any of my companies or the management of the business or affairs of any of my companies or the performance of any at by any person acting as the agent of any of my companies during the period of my specification without the approval of 4th ad 5th (Reginald Saruchera and Samson Mangoma as investigators) respondents is unlawful and is void.”

Mawere cited Home Affairs co-ministers Kembo Mohadi and Theresa Makone and Mines minister Obert Mpofu, as respondents.

He argued his specification could not and did not divest him of ownership of his assets but legally disabled him in disposing his property, entering into any contract for the disposal of his property or operating any account with any bank, building society or financial institution.

Some of the companies Mawere is demanding control of include SMM Holdings, African Associated Mines, Turnall Holdings, Cernol Chemicals Zimbabwe, Turnall Fibre Cement Bulawayo and Harare, Firstel Cellular and Midsec Private Limited.

Mawere is also demanding that his rights, title and interest in his Mount Pleasant property be restored.
