Killer escapes hangman’s noose


A 23-year-old Chipinge man who killed his friend for stepping on his foot while dancing in a bar has escaped the hangman’s noose.

High Court judge Justice Felistas Chatukuta sentenced Oliver Muchayi to 12 years after considering he was drunk when he committed the crime.

Muchayi was convicted of killing Boniface Mutisi whom he struck several times on the head with an iron bar following an altercation between the two.

Justice Chatukuta heard that on the day in question in April this year, Muchayi had visited his home area, Makado Business Centre, from Chiadzwa diamond fields and met the late Mutisi together with his other friends at a bottle store where they were drinking beer.

Muchayi requested to join Mutisi and his colleagues in drinking, but this was turned down resulting in him getting angry and all hell broke loose.

Muchayi then accused Mutisi of stepping on his foot and attacked him.

Prosecutor Michael Mugabe led evidence from Gondai Sithole who told the court he witnessed the argument between the two and that at one point intervened to restrain them from fighting.

Sithole said Mutisi walked out of the bar in an attempt to calm the situation but Muchayi followed him and upon his return he was wielding an iron bar and ordered patrons out of the bar.

Mutisi was found lying in a pool of blood and investigations by the police led to Muchayi’s arrest.
